Overamstel Uitgevers BV, Overamstel Uitgevers België NV and its affiliated imprints (“Overamstel Uitgevers”, “we”, “us” or “our”) respect innovation, research and the lawful use of digital content. This policy explains our position on text and data mining (“TDM”) of content made available by us, including through our websites, online services and electronic publications.

What is TDM?

Text and data mining means automated analytical techniques used to analyse digital text and data in order to generate information, such as patterns, trends or correlations. It may include web crawling, scraping, indexing, extracting, copying, training, fine-tuning or developing artificial-intelligence systems.

Reservation of rights

To the fullest extent permitted by applicable law, Overamstel Uitgevers expressly reserves all rights in relation to text and data mining of the content made available through our websites, online services and electronic publications.

This reservation applies in particular to reproductions, extractions, crawling, scraping, downloading, indexing, copying, analysing or other uses of our content for TDM purposes, including the development, training, testing, validation, fine-tuning or improvement of artificial-intelligence, machine-learning, large-language-model or similar systems.

Accordingly, no permission is granted to use our content for such purposes unless Overamstel Uitgevers has given prior written permission or the use is permitted by mandatory applicable law.

This reservation is intended to constitute an express reservation of rights for the purposes of Article 4 of Directive (EU) 2019/790 on copyright and related rights in the Digital Single Market and the corresponding provisions of applicable national law, including Article 15o of the Dutch Copyright Act (Auteurswet).

Research exception

Nothing in this policy is intended to limit rights that cannot lawfully be excluded or restricted. In particular, this policy does not affect the mandatory statutory exception for TDM carried out by eligible research organisations and cultural heritage institutions for the purposes of scientific research, where the legal conditions for that exception are met.

Scope and third-party rights

This policy applies only to rights held or controlled by Overamstel Uitgevers. Certain content may be owned or controlled by authors, illustrators, photographers, licensors, publishers or other third parties. Their rights are separately reserved and must be respected.

The presence of a work on one of our websites, services or electronic publications does not mean that it is free to use, reproduce, mine, train on, or otherwise exploit.

Technical measures and access conditions

Where applicable, our reservation of rights may also be communicated through machine-readable means, metadata, robots.txt files, access controls, licence terms or other technical measures. You must not bypass, disable or circumvent such measures.

Access to our websites and services remains subject to our applicable terms of use, licence terms and other access conditions. These may impose additional restrictions.

For requests concerning licences or permissions for TDM, AI training or other automated uses of our content, please contact us.

Any permission must be confirmed in writing by an authorised representative of Overamstel Uitgevers. Silence, technical accessibility, or the absence of a technical restriction does not constitute permission.
